Complaints & Conduct Duty to Report

(Mandatory Reporting)

Members of the College

Section 73(1) of the Social Work Profession Act requires members to inform the registrar if they believe another member has a physical or mental condition that makes them: 1) unfit to practice, or 2) in need of practice restrictions.

Employers

Section 74(1) of the Social Work Profession Act requires employers to promptly report if a social worker is fired for misconduct, incompetence, or incapacity. The employer must inform the registrar and give the social worker a copy of the report.

Failure to Report

The Social Work Profession Act states that failing to report is an offense.

If convicted, there can be a fine of up to $10,000. College members who fail to report may also face allegations of professional misconduct.
